Raw Motion Fitness - Terms and Conditions (September 2025 Edition)

HEALTH

If you experience any pain, discomfort, or injury during your sessions, it is important to immediately inform Brendan Turner so that appropriate action can be taken. Prior to or during coaching, there may be health concerns that require input from a doctor, physiotherapist, or other healthcare professional. In such cases, it is recommended to consult a health professional before continuing coaching sessions.

Brendan Turner is not a medical professional and cannot diagnose or prescribe treatment for any medical condition. By agreeing to these terms, you confirm that you are physically fit and do not have any medical conditions that would hinder your participation in coaching sessions.

PAYMENTS AND FEES

There are three main packages with Raw Motion Fitness: Fundamental, Intermediate, and Advanced (Monthly, Weekly, or Multiple Weekly sessions). These packages will be outlined during the initial consultation and detailed in the most current coaching brochure.

All fees for coaching sessions are paid via recurring card payment unless otherwise agreed. This is set up upon registration and allows for easy account management. Where fees fall into arrears, no further sessions will be delivered until the balance is cleared.

INVOICES

Payments agreed upon via invoice must be paid before sessions commence. This allows Brendan to allocate your slot and manage the waiting list. Late payments may incur a fee or result in cancellation of your coaching agreement. Coaching fees may vary annually; any changes will be provided in writing with adequate notice.

If payment fails, no further coaching sessions will be provided until arrears are settled. Sessions not attended or booked will be forfeited, except in the case of medical or family emergencies.

MINIMUM COMMITMENT & NOTICE

All Fundamental, Intermediate and Advanced programmes have a minimum 3‑month commitment. After the initial term, memberships continue monthly until cancelled. To cancel beyond the minimum term, one month’s notice is required (given by email).

On giving notice, any remaining prepaid sessions must be used within 90 days (unless paused for a medical reason agreed in writing). Sessions not used within that period will expire.

NON-ENGAGEMENT CLAUSE (6‑MONTH RULE)

If a client does not attend any sessions or respond to communication for six consecutive months, their account will be considered dormant. Access to booking will be paused and any regular session slot may be offered to another client.

Sessions during dormant periods are not refundable or rolled over. Clients wishing to resume training must email Raw Motion Fitness to request reactivation.

HOLIDAYS, CANCELLATIONS & LATE ARRIVALS

Please give adequate notice for any holidays impacting your sessions. Brendan will do the same.

• Client cancellations: Sessions cancelled with less than 24 hours’ notice will be forfeited unless emergency circumstances apply.
• Coach cancellations: If Brendan cancels within 24 hours, your session will be rebooked at the earliest mutually convenient time.
• Late arrivals: Late arrivals reduce the session length. Arrivals over 20 minutes late may be cancelled and charged in full.

Persistent no‑shows or late cancellations may result in the loss of any reserved prime‑time slot.

RESULTS‑BASED BUSINESS

Raw Motion Fitness operates on a results‑based model focused on biomechanics, holistic health, and structured progression. Results require consistent attendance and practice between sessions. Brendan provides guidance, programming, and accountability; outcomes depend on your active participation.

COMMUNICATION POLICY

  1. Clients must respond to communications about bookings, feedback or session planning.

  2. Feedback is encouraged to maximise outcomes.

  3. Photos or videos may be used for progress review. Please inform Brendan if you do not wish these to be used for marketing.

  4. Referrals are welcome but please ensure they are aware of these terms.

FORMAL COMMUNICATIONS

All formal communications — including cancellations, programme changes, complaints, or disputes — must be made by email. WhatsApp or text messages are for convenience only and are not valid for contractual matters.

Raw Motion Fitness will respond to formal concerns or disputes raised by email within 7 business days.

SESSION AUDITS

Session usage is tracked and available upon request (allow 7 business days for reporting). Programme details are available on the current programme page or as a PDF upon request.

INJURIES, LIABILITY & INDEMNITY

Any injury, discomfort or change in medical status must be reported within 7 days of occurrence. Attendance at sessions confirms that you are fit to train.

To the fullest extent permitted by law, Raw Motion Fitness shall not be liable for any indirect, consequential or special loss. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, or for fraud. In all other cases, Raw Motion Fitness’s total liability arising out of or in connection with the services shall be limited to the total fees paid by you in the 12 months preceding the event giving rise to the claim.

You agree to indemnify Raw Motion Fitness against any loss, costs or expenses arising from your breach of these Terms, misuse of facilities/equipment, or failure to disclose relevant health information.

PROGRAMME STRUCTURE AND UPDATES

Raw Motion Fitness reserves the right to amend or evolve the structure of all coaching programmes annually to ensure best practice and client outcomes. Lifetime Memberships follow the current Intermediate Programme structure, ensuring continued value and consistency. While features may change, the core level of support will remain fair and equivalent to the original investment.

LIFETIME MEMBERSHIPS (LEGACY OFFER)

Lifetime Memberships were a one‑time, bespoke offer provided to a limited number of clients during a transitional period in the business. They are non‑transferable and non‑resellable. Lifetime members are subject to the same engagement expectations and policies as all clients.

PRIME‑TIME SLOT PROTECTION

Reserved session slots (e.g., early mornings/evenings) cannot be held indefinitely without consistent attendance. Repeated last‑minute cancellations or no‑shows may result in the slot being offered to another client.

SESSION EXPIRY

All prepaid sessions must be used within the agreed timeframe, typically within the membership cycle. Sessions not used within this timeframe may expire at the discretion of Raw Motion Fitness.

REFUNDS POLICY

Refunds are only available within the 14‑day cooling‑off period following purchase. Refunds are not issued for dissatisfaction, disengagement, or non‑attendance, unless supported by medical evidence and agreed in writing. Where a medical refund is agreed, Raw Motion Fitness may request supporting evidence (e.g., a GP/consultant letter) stating the nature and expected duration of restriction.

WEBSITE & INTELLECTUAL PROPERTY

Use of the Raw Motion Fitness website or associated digital services implies acceptance of these Terms, the Privacy Policy, and any service‑specific conditions.

All intellectual property — including coaching frameworks, written content, videos and educational materials — is owned by Raw Motion Fitness. No materials may be copied, distributed or shared without written permission. By submitting materials (e.g., testimonials, progress media) you confirm you hold rights to them and grant Raw Motion Fitness a perpetual, royalty‑free licence to use them for professional purposes. You can withdraw consent for marketing use at any time by emailing us.

DISPUTE RESOLUTION

Both parties agree to make reasonable efforts to resolve any dispute via direct communication before taking external legal or regulatory action.

JURISDICTION

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute or claim.

SIGNED AGREEMENT

All clients must acknowledge and sign acceptance of these Terms before commencing coaching. A digital signature or confirmation via email constitutes acceptance.
